01Cambodia to Restore Cross border Adoption of Cambodian Children Regulations
The Cambodian Ministry of Social Welfare and the Italian Cross border Adoption Committee held talks to discuss the resumption of allowing the adoption of Cambodian children. In 2009, in order to prevent Cambodian children from becoming victims of commercial human trafficking, the Cambodian government decided to temporarily prohibit foreign individuals from adopting Cambodian children. Subsequently, Cambodia passed the "Law on the Adoption of Children by Foreigners", but due to some legal and technical issues, the relevant procedures have not been implemented.
According to the Law on the Adoption of Children by Foreigners in Cambodia, Cambodian children adopted by foreigners must be orphans or children adopted by institutions under the Cambodian Ministry of Social Welfare. The age of adopted children should be under 8 years old, but children who require special care can be under 18 years old. The couple applying for the adoption of a child must be at least 30 years old, or at least 22 years older than the adopted child, but must not exceed 45 years old. Applicants for the adoption of Cambodian children must be legitimate citizens of countries that have established diplomatic relations with Cambodia. The adopters should also be couples without children or with only one child, and they must have the ability to protect and raise children. In addition, the adopters must regularly report the status of the adopted children to the relevant departments in Cambodia.
According to data provided by the Cambodian Committee for Foreigners to Adopt ChildrenBetween 2002 and 2011, approximately 3728 Cambodian children were adopted by foreigners. Among them, Italy is the country with the most adopted Cambodian children. Italy stated that it has provided training to Cambodian officials, including adoption procedures, laws, and protection of children's rights, to comply with international law regulations and requirements. Italy also has specialized agencies in place to liaise with relevant Cambodian departments.
